1. These terms

In short: By using symetric you're agreeing to this document. Consenting to what we do with your health information is asked for separately, in its own steps, and covered in the Privacy Policy.

These terms are an agreement between you and SCK Digital, ABN 79 120 082 906 (“symetric”, “we”, “us”, “our”). They govern your use of the symetric mobile app.

By creating an account or using the app, you agree to these terms. If you do not agree, do not use the app.

These terms work alongside our Privacy Policy, which explains how we handle your information, including the separate, specific consent steps we ask for before collecting any health information. Accepting these terms and consenting to data collection aren’t the same thing, but completing account setup means you’ve done both.

2. Who can use symetric

In short: Adults 18+, located in Australia, one personal account each.

You may use symetric if you are at least 18 years old and located in Australia. The app is for adults only. We ask for your date of birth when you create an account, and we do not permit accounts for anyone under 18.

The app is offered in Australia only. We do not make it available in other countries and we do not represent that it complies with the laws of any other country.

You may create one account for your own personal use. Do not share your account or use someone else’s.

3. Your account

In short: symetric doesn't use passwords, we send a one-time link to your email instead, so keeping your email account secure is what keeps yours secure. Tell us if that changes, and keep your details current.

symetric doesn’t use passwords. Each time you sign in, we email you a one-time link and that link signs you in directly. This means keeping your email account secure is what keeps your symetric account secure, since whoever can open that email can sign in. You’re responsible for activity that occurs under your account. Tell us promptly at privacy@symetric.app if you believe your email account, and so your symetric account, has been compromised.

Please give us accurate account information and keep your email address current, because it is how we reach you about your account, how you sign in, and how we tell you about changes to these terms.

4. Licence to use the app

In short: A personal, non-commercial licence to use the app, no copying, reverse engineering, reselling, or interfering with it.

We grant you a personal, non exclusive, non transferable, revocable licence to install and use symetric on devices you own or control, for your own personal, non commercial use.

You must not:

  • Copy, modify, reverse engineer, decompile or create derivative works from the app, except to the extent the law says you may
  • Sell, rent, sublicense or commercially exploit the app or any part of it
  • Use the app to store or transmit anything unlawful
  • Interfere with the app’s operation or security, attempt to access another user’s data, or use automated means to access the service
  • Use the app in any way that breaches these terms or any applicable law

5. symetric is not medical advice

In short: This is the most important section. symetric tracks patterns in what you enter, it doesn't diagnose, treat, monitor, or replace a health professional.

This is the most important section of these terms. Please read it.

symetric is a self tracking tool. It records what you enter and identifies patterns in your own data.

symetric does not:

  • Diagnose any medical or psychological condition
  • Provide medical advice, treatment recommendations, or a clinical opinion
  • Replace assessment or care by a qualified health professional
  • Monitor you, detect emergencies, or alert anyone on your behalf

The patterns, connections, baseline comparisons, prepared questions and reports the app produces are generated from information you entered about yourself. They are indicative only. They are not clinical findings and they are not a substitute for professional judgement.

Do not start, stop or change any medication or treatment based on anything the app shows you. Always speak with your doctor or other qualified health professional.

6. If you need urgent help

In short: symetric isn't a crisis or monitoring service, call Lifeline or 000 instead.

symetric is not a crisis service and nobody is monitoring your entries in real time.

If you are in distress or concerned about your safety, contact your doctor, call Lifeline on 13 11 14, or call 000 in an emergency.

7. Accuracy of patterns and reports

In short: Results are only as good as what you enter, confidence ratings aren't clinical findings, and your practitioner interprets any report.

The app’s analysis depends entirely on what you enter and how consistently you enter it. Gaps in your check-ins, inaccurate entries, or a short history will affect the results.

Pattern detection uses statistical methods with confidence ratings, and those ratings describe the strength of a pattern within your own data. They do not indicate that a pattern is clinically meaningful.

Reports you generate are a summary of your own records prepared for your convenience. Your treating practitioner is responsible for interpreting them and for any clinical decision.

8. Your information and your entries

In short: Your entries are yours. We only get the limited licence needed to run the app, never to sell, advertise with, or use to train AI.

The entries you make in symetric are yours. We do not claim ownership of them.

You grant us the limited permission we need to store, process and display your entries so we can operate the app for you, and for no other purpose. We do not sell your information, use it for advertising, or use your health information to train artificial intelligence systems.

Our handling of your information is set out in the Privacy Policy, which forms part of your relationship with us.

You are responsible for what you do with reports you generate. Once you share a report with someone, it is outside our control.

9. Fees

In short: AU$9.99 once, no subscription. Covered by the 28-day guarantee. If paid add-ons come later, you'll get advance notice and your existing features won't be paywalled.

symetric is a one-off purchase of AU$9.99. There is no subscription and no recurring charge. This purchase is covered by the 28-day guarantee.

Your purchase is made and billed through the Apple App Store or Google Play under their terms, and you would manage any refund request through us as described in the guarantee, or through your App Store or Google Play account settings.

We may introduce additional paid features in future. If we do:

  • We will give you advance notice before any charge applies to you
  • Features you already have will not be moved behind a paywall without notice and a reasonable opportunity to export your data and close your account
  • Any such purchase would be billed through the Apple App Store or Google Play under their terms, and you would manage or cancel it through your App Store or Google Play account settings rather than through us
  • Your rights under the Australian Consumer Law would continue to apply

10. Availability and changes to the app

In short: We aim to keep the app running but don't guarantee uninterrupted service, keep your own copies of anything important.

We aim to keep symetric available and working, but we do not guarantee that it will be uninterrupted, error free, or available at any particular time.

We may update, change or remove features. If we remove a feature you rely on, or make a change that materially reduces the service, we will give you reasonable notice where we can.

We may need to suspend the service temporarily for maintenance, security or technical reasons.

Please keep your own copies of anything important to you. While we take care with your data and maintain backups, you should not treat the app as your only record.

11. Suspending or closing your account

In short: You can close your account any time; we can only suspend or close yours for serious breach, legal reasons, or discontinuing the app, usually with notice.

You can close your account at any time from within the app. This deletes your data as described in the Privacy Policy, and it cannot be undone.

We may suspend or close your account if you seriously or repeatedly breach these terms, if we are required to by law, or if we discontinue the app. Except where we are prevented by law or where the breach makes it inappropriate, we will give you notice and a reasonable opportunity to export your data first.

If we discontinue symetric entirely, we will give you reasonable advance notice so you can export your data.

12. Apple and Google

In short: You got the app through an app store, and its terms apply too, but any problem with symetric itself comes to us, not them.

You obtained symetric through the Apple App Store or Google Play, and your use is also subject to their terms.

Apple and Google are not parties to these terms and are not responsible for symetric, its content, or any support, maintenance or claims relating to it. That responsibility is ours. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

If you have a problem with the app, contact us at support@symetric.app, not Apple or Google.

13. Our intellectual property

In short: We own the app, its design, code, branding and analysis methods.

We own the app, its design, code, branding and the methods it uses to analyse data. Nothing in these terms transfers any of that to you beyond the licence in section 4.

14. Your rights under the Australian Consumer Law

In short: Nothing in this document overrides guarantees you have under the Australian Consumer Law.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be supplied with due care and skill.

15. Limits on our liability

In short: We limit our liability where the law allows, and we're not liable for clinical decisions made from app data since we don't provide medical advice.

Subject to section 14, and to the extent the law permits:

We are not liable for any loss that was not reasonably foreseeable, or for indirect or consequential loss.

We are not liable for any clinical decision, treatment change or health outcome arising from your use of the app or from anything it displays or produces, because symetric does not provide medical advice and is not a substitute for professional care.

Where our liability can be limited rather than excluded, our liability to you is limited to the amount you paid us in the 12 months before the claim.

Nothing here limits our liability for fraud, or for anything else the law does not permit us to limit.

16. Changes to these terms

In short: We'll notify you before any material change takes effect, and you can close your account if you don't accept it.

We may update these terms. If a change materially affects your rights, we will notify you in the app or by email before it takes effect, and you will have the opportunity to close your account if you do not accept it.

Continuing to use the app after a change takes effect means you accept the updated terms. The current version is always available in the app and at symetric.app/terms.

17. General

In short: Standard legal boilerplate, severability, no waiver, Victorian law.

If any part of these terms is found to be unenforceable, the rest continues to apply.

If we do not enforce a right straight away, we have not given it up.

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction, though this does not affect any right you have to bring proceedings elsewhere under the Australian Consumer Law.

18. Contact us

In short: Support and privacy contact details.
